1. Acceptance of these terms
These Terms of Service (“Terms”) govern your access to and use of Uptimewolf, a product of Foldercrate (“Uptimewolf”, “we”, “us”), including the monitoring service, the website at uptimewolf.com and the free tools.
By creating an account or using any part of the service, you agree to these Terms. If you do not agree, please do not use Uptimewolf. If you use the service on behalf of an organisation, you confirm you are authorised to accept these Terms for that organisation.
2. The service
Uptimewolf is an uptime monitoring service. It checks websites, servers, ports, domains, DNS records and game servers, provides status pages and incident alerting, and offers a set of free network tools.
We work to keep the service reliable, but it is provided on an “as available” basis. Monitoring depends on networks and third parties outside our control, so we do not guarantee that every check or alert will be delivered without interruption or delay.
3. Your account
To use the monitoring service you must create an account. You agree to:
- provide accurate registration information and keep it up to date;
- keep your login credentials confidential and secure;
- be responsible for all activity that happens under your account;
- notify us promptly at [email protected] if you suspect unauthorised use.
You must be at least 18 years old, or the age of majority where you live, to hold an account.
4. Free trial
Each plan starts with a 5-day free trial. No credit card is required to begin the trial.
At the end of the trial, you may choose a paid plan to continue using the monitoring service. If you do not subscribe, your access to paid features ends, though the free tools remain available to everyone. We may change the terms of the free trial for future sign-ups.
5. Plans, billing and payment
Paid plans are offered on a subscription basis, billed monthly or annually as shown at checkout. Pricing starts at $2.99 per month and current prices are published on our pricing page.
- Payment. Payments are processed by Stripe. By subscribing, you authorise us, through Stripe, to charge your chosen payment method for the recurring fee.
- Renewal. Subscriptions renew automatically at the end of each billing period unless you cancel beforehand.
- Price changes. We may change our prices. Any change applies from your next billing period, and we will give you reasonable notice.
- Taxes. Prices may exclude applicable taxes, which will be added where required.
6. Cancellation and refunds
You can cancel your subscription at any time from your account settings. When you cancel, your plan stays active until the end of the current billing period, and it is not renewed after that.
Except where required by applicable law, payments already made are non-refundable, and we do not provide partial refunds for unused time in a billing period. The 5-day free trial exists so you can evaluate the service before paying.
7. Acceptable use
You agree to use Uptimewolf lawfully and only to monitor systems you own or are authorised to monitor. You must not:
- use the service to monitor, probe or attack systems without permission;
- use the service or free tools to harass, overload or disrupt any third party;
- break any applicable law or infringe anyone's rights;
- attempt to gain unauthorised access to Uptimewolf, its infrastructure or other accounts;
- resell or redistribute the service except as expressly permitted;
- interfere with the integrity or performance of the service.
We may suspend or terminate accounts that breach this section.
8. Free tools
Uptimewolf provides free network tools that anyone can use without an account. These tools are offered for convenience and for one-off checks, on an “as is” basis.
The free tools are separate from the paid monitoring service and may be changed, rate-limited or withdrawn at any time. You must not abuse the tools or use them to disrupt others.
9. Service availability
We aim to keep Uptimewolf running reliably and to deliver checks and alerts promptly. However, the service may occasionally be unavailable for maintenance, updates, or reasons beyond our control, and monitoring accuracy depends on third-party networks.
You should not rely on Uptimewolf as the sole safeguard for critical systems. We are not liable for any loss arising from a missed, delayed or inaccurate check or alert, to the extent the law allows.
10. Intellectual property
Uptimewolf, the Uptimewolf and Foldercrate names, the software, design and content of the service are owned by Foldercrate and protected by intellectual property law. These Terms do not transfer any ownership to you.
The data you enter - your monitors, settings and results - remains yours. You grant us the limited rights needed to operate the service for you, such as storing and processing that data to run your checks and show your dashboards.
11. Third-party services
Uptimewolf relies on third parties to operate, including Stripe for payments and Hostpoint for hosting. Your use of the service may also involve third-party platforms you connect for notifications, such as Slack, Discord, Telegram, Microsoft Teams or Google Chat.
Those third parties have their own terms and policies, and we are not responsible for their services. How we handle your data is described in our Privacy Policy.
12. Disclaimer of warranties
To the maximum extent permitted by law, Uptimewolf and the free tools are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.
You use the service at your own discretion and risk, and are responsible for ensuring it meets your requirements.
13. Limitation of liability
To the maximum extent permitted by applicable law, Foldercrate will not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, revenue, data or business, arising from your use of, or inability to use, Uptimewolf.
Where liability cannot be excluded, our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
14. Suspension and termination
You may stop using Uptimewolf and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the service in a way that risks harm to us or others.
On termination, your right to use the paid service ends. We may delete your data after a reasonable period, subject to our Privacy Policy and any records we must keep by law.
15. Changes to these terms
We may update these Terms from time to time to reflect changes to the service or to legal requirements. When we make a material change, we will update the date below and, where appropriate, notify you.
Continued use of Uptimewolf after an update means you accept the revised Terms. If you do not agree to a change, you should stop using the service and may cancel your subscription.
16. Governing law
These Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules. The courts at the registered seat of Foldercrate in Solothurn, Switzerland have jurisdiction over any dispute, subject to any mandatory consumer-protection rules that may apply in your country of residence.
